<p style="text-align: justify;"><span style="color: #ff6600;">&#8220;UAE paid $10m to settle the U.S. Torture case of its citizen while he was in UAE way back in 1984. The most genuine case of an Indian Investor and Trader in Abu Dhabi, UAE, in 1995, the most heinous and multifarious crimes perpetrated by &#8216;the de facto head of the UAE Federation, Mohammed bin Zayed Al Nahyan, on UAE soil, stands unsettled even after twenty two years ridiculing the &#8216;Judgment Creditor&#8217; of the case, and casting shame on both India and UAE&#8221;</span></p>
<p style="text-align: justify;">We should all be ashamed of the government of India&#8217;s rotten and unprincipled diplomacy, in spite of the passing of 4 consecutive Judgments from the UAE Courts, including the ‘Landmark Judgment’ from Apex Court of Abu Dhabi in absolute, in favour of an India-born, Abu Dhabi-based investor and trader, as well as two other judgments from the High Court of Delhi, which was moved after approaching the Hon. Supreme Court of India, against the de facto head of the UAE, the Crown Prince Sheikh Mohammed bin Zayed Al Nahyan, who perpetrated, masterminded, and triggered many different kinds of violent crimes against an Indian investor in UAE, including fraud, torture and looting, in order to withdraw a civil lawsuit against his associate, on a building tower contract in 1995.</p>
<p style="text-align: justify;">It is inconceivable that when anti-social elements hatch a conspiracy and attempt virtual destruction of a continued life, the violators of law in the State are protected by the United Arab Emirates. The situation cannot be allowed to pass unnoticed by a responsible and civilized Governments in India, when the facts and files establish such wanton violations of Human Rights against a citizen.</p>
<p style="text-align: justify;">‘The US Authority was keen and honest to take up the case of its citizen with the UAE government and the claim was settled just in 3 years’.  On the other hand, the Government of India did an unpardonable mistake of dragging the most legitimate case of an Indian investor and trader in UAE for a long period of 22 years as of now, despite a portfolio of six legal judgments from different Courts in his favour.</p>
<p style="text-align: justify;">‘It would appear that, the big heads in the Ministry of External Affairs, Government of India, is hand in glove with the criminal nexus in the UAE. Why should the Indian authorities stand in the way and resist an Indian citizen seeking redress and enforcement of a set of foreign judgments in Indian Courts?</p>
<p style="text-align: justify;">The transformation of a U.S. Human Rights Lawsuit against Abu Dhabi&#8217;s Crown Prince Sheikh Mohammed bin Zayed Al Nahyan to a $10 million settlement is a living example of successful foreign relations among responsible States who value the dignity of its citizens’. Honestly, the Government of India should awake and act now or the next generation will feel ashamed of being born in India!</p>
<p><strong><span style="color: #ff6600;">‘KHALED AL HASSEN V. SHEIKH KHALIFA BIN ZAYED AL NAHYAN’<br />

<p style="text-align: justify;">Nearly three decades after the UAE bought the silence of Khaled al-Hassen, a naturalized U.S. citizen, who was allegedly tortured by Mohammed bin Zayed Al Nahyan, crown prince of Abu Dhabi, during the 1980s, according to documents leaked from the hacked email account of Yousef al-Otaiba, the Emirati ambassador to the US, obtained media outlets.</p>

<p style="text-align: justify;">Khaled Hassen secured a $10 million settlement in 2013 roughly 3 years after filing the lawsuit in a U.S. District Court, against the top three members of the UAE’s ruling family. As a condition of his settlement, Hassen is not allowed to speak about the case.</p>
<p style="text-align: justify;">Khalid Hassan’s case against three senior members of the UAE ruling family, Crown Prince of Abu Dhabi Mohammed bin Zayed Al Nahyan, UAE President Khalifa bin Zayed Al Nahyan and retired Brigadier General Saeed Hilal Al-Darmaki, was brought in 2009  before the Federal Court in Los Angeles when Hassan’s lawyers cited the State Department’s telegrams as an evidence of his detention in the UAE, which were published in 2006, that highlight attempts by the US embassy to locate and secure his release.</p>
<p style="text-align: justify;">Khaled Hassen alleged that he was abducted, taken to a secret location, tortured and forced to sign a false confession while working in the United Arab Emirates. The lawsuit seeking civil monetary damages from three members of the royal family in Abu Dhabi, including the Emir, a key U.S. ally in the Middle East.”</p>
<p style="text-align: justify;">After initially denying the charges, the UAE admitted that Hassan was being held by a state security agency under high level government supervision. The attorneys for defendants argued that, litigating plaintiff’s claim in California District would be inefficient and unfair for defendants, who reside in the UAE and hold extremely high governmental positions which require their presence and attention. Therefore, Plaintiff’s claims should be dismissed.</p>
<p style="text-align: justify;">While the judge Dolly Gee, Central District court, warned that the lawsuit may be rejected because the defendants were in the UAE, lawyers argued that the ambassador of the United Arab Emirates was in the US and the judge to accept the case.</p>
<p style="text-align: justify;">Although U.S. Courts normally only hear trials in cases where due process has been exhausted in the country where the crimes were committed, Hassan argued that judiciary in the UAE is run and governed by the same people who tortured him and therefore the trial would not be independent.</p>
<p style="text-align: justify;">During the case the Emirati ambassador to the US was worked behind the scenes to protect members of the ruling family. The president’s name was removed from the case for diplomatic reasons. However, the trial judge would not accept the argument of diplomatic immunity for Crown Prince Mohammed bin Zayed Al Nahyan and General Saeed al-Darmaki.</p>

<p style="text-align: justify;">The points raised by the U.S. attorneys for defendants in the torture case, United States, stood a powerful deterrent against his ‘defendants’ in UAE whereas the Indian investor had taken up his case soon after he was <a title="UAE TORTURE" href="http://www.boycottuae.com/uaeblog/marking-the-20th-anniversary-of-the-abu-dhabi-police-looting-in-abu-dhabi-united-arab-emirates" target="_blank">attacked, looted and kidnaped</a>, further arbitrarily detained for over a year in different torture chambers in Abu Dhabi, UAE.</p>
<p style="text-align: justify;">All his claims were proved in the legal Courts of Abu Dhabi, United Arab Emirates (UAE). The Hon. Court has  issued investigation orders against the conspirators, the Abu Dhabi police and others. To escape from prosecution in the UAE Courts, the winner, the India-born Investor was fraudulently deported to India by the de facto head of UAE, Mohammed bin Zayed Al Nahyan, kicked off all the Judgments pronounced by the Judiciary, absolutely in favour of the Indian investor. PETERSBURG — The Group of 20, which comprise the largest economies of the world, split down the middle Friday on the question of supporting the United States in punishing Syria’s government for apparently gassing civilians two weeks ago in Damascus. Russian President Vladimir Putin and Obama held a 20-minute meeting on Syria but failed to reach an agreement.</p>
<p style="text-align: justify;">Putin said he and U.S. President Barack Obama stuck to their positions over Syria but listened to each other during a one-on-one meeting on the sidelines of the G20 summit on Friday, and are looking for ways forward. Putin has been among the loudest critics on the international stage of Obama&#8217;s push for a military strike in Syria. He has said in recent interviews that a strike would be illegal if the United Nations does not support it.</p>
<p style="text-align: justify;">Speaking in St. Petersburg, Chinese Vice Foreign Minister Zhu Guangyao said Thursday any military action against Syria would cause a hike in oil prices and have a &#8220;negative impact&#8221; on the global economy. Russia, Syria&#8217;s main supplier of arms, and China have already vetoed three U.N. Security Council resolutions on Syria.</p>
<p style="text-align: justify;">As the G-20  two-day summit ended in St. Petersburg, the White House released a joint statement endorsed by U.S. President Barack Obama and 10 other G-20 nations. It said: The international norm against the use of chemical weapons is longstanding and universal.  The use of chemical weapons anywhere diminishes the security of people everywhere.  Left unchallenged, it increases the risk of further use and proliferation of these weapons.</p>
<p style="text-align: justify;">We condemn in the strongest terms the horrific chemical weapons attack in the suburbs of Damascus on August 21st that claimed the lives of so many men, women, and children.  The evidence clearly points to the Syrian government being responsible for the attack, which is part of a pattern of chemical weapons use by the regime.</p>
<p style="text-align: justify;">We call for a strong international response to this grave violation of the world’s rules and conscience that will send a clear message that this kind of atrocity can never be repeated.</p>
<p style="text-align: justify;">Those who perpetrated these crimes must be held accountable. Signatories have consistently supported a strong UN Security Council Resolution, given the Security Council&#8217;s responsibilities to lead the international response, but recognize that the Council remains paralyzed as it has been for two and a half years.  The world cannot wait for endless failed processes that can only lead to increased suffering in Syria and regional instability.  We support efforts undertaken by the United States and other countries to reinforce the prohibition on the use of chemical weapons.</p>

<p style="text-align: justify;">Speaker John A. Boehner, who with other Congressional leaders met Mr. Obama in the Oval Office, said afterward that he would “support the president’s call to action,” an endorsement quickly echoed by the House majority leader, Representative Eric Cantor of Virginia.</p>
<p style="text-align: justify;">On Tuesday evening, Democrats and Republicans on the Senate Foreign Relations Committee agreed on the wording of a resolution that would give Mr. Obama the authority to carry out a strike against Syria, for a period of 60 days, with one 30-day extension. <p style="text-align: justify;"><strong><a href="http://www.reparationlaw.com/statepractices/reparation_mechanisms_india_gulf.php"><img class="size-medium wp-image-405 alignleft" alt="indo_gulf_rep" src="http://www.reparationlaw.com/news/wp-content/uploads/2013/03/indo_gulf_rep-300x207.jpg" width="300" height="207" /></a>Sub: Representation for ‘Indo-Gulf Reparation Mechanisms’ ­– </strong>[Strategy Formulation and Implementation of a Mutual Human Rights Law and Reparation Mechanisms Between the Government of India and the GCC (Gulf Cooperation Council) countries, mandating our elected representatives and officials to eliminate discrimination and imbalances of Non-resident Indians (NRIs) working in different countries. This also involvesthe recognition and protection of the dignity and respect of individuals].</p>
<p style="text-align: justify;">Dear Sir,</p>
<p style="text-align: justify;">The petitioner is a citizen of India, and now resident in the State of Kerala.  The petitioner was subjected to a most inhuman treatment by the authorities of U.A.E.  They are detailed separately.</p>
<p style="text-align: justify;">There have been momentous developments in relation to relations between people working in areas outside their own motherland.  These include important international developments like UN General Assembly Resolution.</p>
<p style="text-align: justify;">Here again, there had been dismal failure of the Government machinery to rise to the expectations of the toiling masses outside India.  In particular, the experiences of those who work in the Gulf countries have been extremely agonizing.</p>
<p style="text-align: justify;">The situation cannot be allowed to pass unnoticed by a responsible and civilized Government.</p>
<p style="text-align: justify;">Many of the member states work in collaboration with the UN Human Rights Mechanisms and treaties detailed by the United Nations.  A brief resume of such measures adopted in different countries are contained in Annexure 1.</p>
<p style="text-align: justify;">The Charter of the Organization of American State signed in 1948, the Charter of Council of Europe adopted in 1950, and the similar Charter in Africa adopted in 1987, are prominent illustrations of the expanding vistas of Human Rights.</p>
<p style="text-align: justify;">In this background, a clear-cut inter-Governmental working arrangement was an absolute necessity between India and the Gulf Cooperation Council (GCC) countries.</p>
<p style="text-align: justify;">It is sad but true that such an arrangement is not even conceived of even at this late hour.  Consequently, no regional inter-Governmental Human Rights Mechanisms or any procedure incorporating those precious liberties of citizens had been framed.</p>
<p style="text-align: justify;">It has to be remembered in this connection that the remittances of these poorer sections buildup $70 billion of US Dollars of the precious foreign exchange to India.</p>
<p style="text-align: justify;">These wage earners, and hardworking citizens of India, should be insulated against any violations of Human Rights.  The absence of an effective Reparation Mechanism assumes greatest importance in that background.</p>
<p style="text-align: justify;">It has to be remembered that stories of torture and deprivation continue to flow steadily in the working conditions of the Gulf migrants.A most naked and cruel violation of Human Rights (torture included) is illustrated with reference to the personal experiences of the petitioner.</p>
<p style="text-align: justify;">When the facts and files establish such wanton violations of Human Rights, a clear duty is implied on the part of the country wherein the Indian citizens had worked and added to the assets of that country, to give him effective reparation.</p>
<p style="text-align: justify;">The following is the tragic story of the petitioner:</p>
<p style="text-align: justify;">The petitioner was a businessman and investor engaged in the business of ‘Trading and General Contracting’ in Abu Dhabi, UAE for over 18 years. He was attacked by a posse of policemen at his office; robbed of cash and valuables to force him to withdraw a lawsuit against a property owner. He sought intervention from the police. The police did come, but instead of helping him, he was shackled and literally dragged out of the office and on through the street in the presence of known friends and other members of the community. He was confined to a detention center and brutally tortured and later taken to central prison. It took six months thereafter, for the petitioner to have his first appearance in Court</p>
<p style="text-align: justify;">He was implicated in a false case by the Police.  The charge was about &#8220;Using force against Government employee and assault&#8221;.</p>
<p style="text-align: justify;">The Judges of both the Trial Court and the final Appellate Court of Abu Dhabi found that the petitioner innocent; ‘a martyr’.</p>
<p style="text-align: justify;">The Hon’ble Judges instructed the authorities to release the victim immediately.</p>
<p style="text-align: justify;">The Judges declared that the case was wholly false, baseless and that it was fabricated by the police for personal gain.</p>
<p style="text-align: justify;">The Court, therefore, while pronouncing its judgment ordered to restoration of the victim’s dignity, and to compensate him for all his losses.</p>
<p style="text-align: justify;">Any civilized Government, more so a Member of United Nations, should have hastened to implement the judicial directive.</p>
<p style="text-align: justify;">Sad to state, the offending officials of the state ignored the judicial verdict and deported the victim, totally deprived of all his assets, papers and records.</p>
<p style="text-align: justify;">This superstition of a judicial decision by executive fiat is rank subversion of the rule of law.</p>
<p style="text-align: justify;">It is in this context that the convention becomes absolutely relevant.The Government should not delay any longer the follow up steps to ensure that the Indian citizens justice long overdue. (Annexure 2)</p>
<p style="text-align: justify;">When in so many other countries theCharters have been established in pursuance to Articles 55 and 56 of the UN Charter, India SHOULD NOT HAVE lagged behind.</p>
<p style="text-align: justify;">When this grievance was placed before Justice <a href="http://www.reparationlaw.com/statepractices/preface_by_v_r_krishna_Iyer.php"><strong>V.R. Krishna Iyer</strong></a>, he was, despite his many critical disabilities, generous enough to give useful directions.  This representation is prepared in the light of the guidelines suggested by him.</p>
<p style="text-align: justify;">The grievances of the petitioner are intimately known to <a href="http://www.reparationlaw.com/statepractices/covering_letter_by_justice_k_sukumaran.php"><strong>K. Sukumaran</strong></a>, Senior Advocate of the Supreme Court of India, who pleaded for the petitioner in the Hon’ble Supreme Court and in the High Court of Delhi.  He was a former Judge, High Court of Kerala and Bombay.</p>
<p style="text-align: justify;">The petitioner earnestly appeals to the Government of India to evolve an Indo-Gulf Reparation Mechanism, to wipe off the tears from the eyes of many thousand overseas Indians toiling in the desert land, and their family members.</p>
<p style="text-align: justify;">The petitioner submits hereunder the major recommendations that could be considered by the Government expeditiously and meaningfully:</p>
<ul>
<li>a) Establishment of an ‘Indian Migrant Cell’.  It should have the required high status and power.  Technical experts and involvement of a UN Special Rapporteur on Human Rights of Migrants, the UNHCR, the International Labour Organization (ILO) and the International Organization for Migration (IOM) included.</li>
<li>b) Establishment of the MOA (Memorandum of Agreement) and MOU (Memorandum of Understanding) with regards to the Strategy Formulation and Implementation of a Mutual Reparation Mechanism Between India and the GCC countries for safeguarding the rights and dignity of NRIs and ensuring quick relief to the suffering migrants, as regards working condition, assurance for continued contacts with family and safe return to the home, without any tension, suspense or torment.</li>
<li>c) Ensuring periodic visits by representatives of the Indian Government and of the Kerala and other State Governments about the living conditions of persons confined to prisons.  That too is an incident of Human Right.</li>
<li>d) Educational arrangements to inform officials and non-officials concerned of the rights and interests of the migrants including the scope of UN Human Rights Special Procedures Mechanisms.</li>
<li>e) To ensure effective and meaningful participation of the representatives of the Government of India in the meetings of Inter-American Charter Session, European Union Charter Session and the African Union Charter Session.</li>
<li>f) Creation of a Reparation Fund on lines similar to the UN Trust Fund for Victims, for affording quickest relief as regards reparation to the victims of Human Rights Violation.</li>
</ul>
<p style="text-align: justify;">The petitioner prays that he may be afforded the facility to call on the Secretary and the Hon’ble Minister to explain the various aspects of the sufferings of the Indian migrants, with a view to make available to them the full protection of Human Rights in letter and spirit.</p>
